These Terms & Conditions (“Terms”) govern your access to and use of Etlyst(the “Platform”, “we”, “us”). By creating an account, checking the acceptance box, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the legal capacity to enter into these Terms, whether on your own behalf or on behalf of a business you are authorized to represent.

Etlyst is a content-generation tool. It helps you produce draft product images and draft listing text (titles, descriptions, and tags) from a product link you supply. That is the entire scope of what we provide.

We do not sell products, operate a store, fulfil orders, provide business, legal, tax, or professional advice, or guarantee any commercial result. What you do with the generated content — including whether, where, and how you publish or sell it — is entirely your own decision and your own responsibility.

The Platform relies on automated and artificial-intelligence systems. AI output is probabilistic and imperfect. Generated images and text may be inaccurate, incomplete, misleading, outdated, low-quality, or entirely wrong. Images may misrepresent a product’s colour, size, materials, proportions, or features. Text may contain factual errors, incorrect specifications, spelling or grammatical mistakes, or claims that are not true of the actual product.

You acknowledge that we cannot and do not guarantee the accuracy, quality, reliability, fitness, legality, or suitability of any generated content for any purpose.

You are solely responsible for reviewing, verifying, editing, and deciding whether to use any content generated by the Platform. Before publishing or relying on any output, you must independently confirm that it is accurate, appropriate, and truthful in relation to the actual product you intend to sell.

Any use of generated content — including uploading it to Etsy or any other marketplace, website, advertisement, or store — is done entirely at your own risk. You knowingly and voluntarily accept that risk. The final product listing, its accuracy, and its compliance are your responsibility, not ours.

Etlyst is an independent tool and is not affiliated with, endorsed by, sponsored by, or connected to Etsy, AliExpress, or any other marketplace, platform, or brand. All product names, trademarks, and logos are the property of their respective owners.

You are solely responsible for complying with the terms of service, policies, seller rules, and content requirements of any marketplace you use (including Etsy and AliExpress), and with all applicable laws. We are not responsible for any account suspension, listing removal, penalty, or other action taken against you by a marketplace or third party.

You are solely responsible for ensuring that you have all necessary rights, licences, and permissions to use any product link, image, or other material you submit to the Platform, and to use the resulting generated content. You must not use the Platform to infringe any copyright, trademark, design right, publicity right, or other intellectual property or proprietary right of any third party.

We make no representation that generated content is free of third-party rights or that your use of it is lawful. Verifying that your source material and your published listings do not infringe anyone’s rights is your obligation alone.

You agree not to use the Platform to:

• create false, deceptive, misleading, or fraudulent listings or advertising;
• sell or promote illegal, counterfeit, unsafe, or prohibited products, or products you are not lawfully entitled to sell;
• infringe the intellectual property or other rights of any third party;
• violate any law, regulation, or third-party marketplace policy; or
• interfere with, abuse, overload, reverse-engineer, or attempt to gain unauthorized access to the Platform.

We may suspend or terminate access, without notice or refund, if we reasonably believe these Terms have been breached.

Paid features are consumed using credits. Credits are consumed when a generation job is run, whether or not you are satisfied with the output. Because AI output is inherently variable, a completed generation is not refundable merely because you dislike or cannot use the result. Nothing in this section limits any rights that cannot be waived under applicable law.

The Platform and all generated content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that any output will meet your requirements or produce any particular commercial result.

To the maximum extent permitted by law, in no event will Etlyst, its owners, operators, employees, contractors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, sales, goodwill, data, or business opportunity, arising out of or relating to your use of (or inability to use) the Platform or any generated content, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for any and all claims relating to the Platform will not exceed the greater of (a) the total amount you paid to us in the three (3) months immediately preceding the event giving rise to the claim, or (b) USD 50.

You agree to defend, indemnify, and hold harmless Etlyst and its owners, operators, employees, and contractors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform or any generated content; (b) your product listings, sales, or dealings with any marketplace or customer; (c) your violation of these Terms; or (d) your violation of any law or of the rights of any third party.

We may modify, suspend, or discontinue the Platform (or any part of it), and we may update these Terms, at any time. Material changes take effect when posted here with an updated “Last updated” date. Your continued use after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which the Platform operator is established, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located there for the resolution of any dispute. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
